I was on an Amtrak train back to Chicago on election day, I went from drunks partying on the Amtrak to watching a knife fight nearly break out on the green line. Inside the city you could feel the tension in the air like a knife, which is very unusual for the windy city I know and love.

As for playing it right, I don't see how the 4th Amendment leaves any room for argument. Everyone involved in this argument is a US Citizen. Equal protection says they get equal access to all legal rights and obligations. Period. There's no "except these people" clause in there.

If the defeat of Prop 8 was done just right than they could have gotten anti-gay marriage laws over turned as unconstitutional all over the country. I think would require the challenge to go to the supreme court. I am not sure. I remember reading about it and thinking that it was a clever way to get the laws changed country wide without have to do it state by state.

I think gay men and women have the right to be a miserable as the rest of us. I mean the right for wedding registries. I mean the right for divorces. Honestly it doesn't really matter who you marry. I have never had reason to believe that stopping them will serve any moral purpose. Their marriages are as stable, if not more so, than traditional marriages. They can raise kids who are better adjusted than from a traditional marriage. There is no reason except that you can't stand those faggots imitation the good and righteous god fearing life you're living. That isn't a reason by the way.

The overturning of Prop 8 has to go to the Federal Supreme Court and be overturned before the ruling would directly apply to other states. Then I suppose those states with gay marriage bans would have to evaluate if the ruling directly addresses their ban, or if the wording is different enough from Prop 8 to require another trip to the State or Federal Supreme Court.

Actually, actually, I was wrong. Apparently only the DA's office and the governor can initiate an appeal, since they were the only defendants. It'll be interesting to see if either office will actually step into that particular PR shitstorm, or just let the ruling stand.
